Your Rights

Understanding your legal rights is the first step in making an informed, educated decision about union representation and how it might impact you.

Section 7 of the National Labor Relations Act (NLRA) protects an individual team member’s right to engage – or not to engage – in union support, membership, and other protected concerted activities. Your decision to support or not support unionization will in no way impact your employment.

You have the right to:

  • Sign or not sign a union authorization card or petition
  • Refrain from any union activity
  • Engage in union activity and support the union
  • Campaign against the union

The National Labor Relations Act also:

  • Forbids the union or its agents to restrain or coerce team members who do not support the union
  • Gives team members the right to file unfair labor practice charges against the union for violations of these rights and to file civil suit against the union if harassed at home

More Rights

You have the right to…

  • support or not support a labor union.
  • receive paychecks free from deductions for union dues, fees, fines or assessments.
  • know all of the facts about unions, including facts unions may not want you to know.
  • not be bothered at home or at work by union organizers. You can tell them no and to leave you alone.
  • ignore phone calls from union organizers.
  • protect your privacy.
  • ask questions of any supervisor or member of Banner’s management team.
  • speak for yourself and to let your feelings be known to others.
  • speak out against dividing our team and hiring a union to deal with the company directly regarding your wages, benefits and other terms and conditions of employment to a labor union.
  • work in an environment where our team members work together as a team with management and not as adversaries.
  • say no to a labor union who is trying to sell union memberships to Banner team members.
